Legal Affairs

About the Legal Affairs Department

The Legal Affairs Department is one of the important and basic departments affiliated to the Presidency of the University of Technology. The department consists of three divisions:

The Claims and Reports Division, the Legal Consultation Division, and the Contracts and Guarantees Division. The department is administratively linked to the assistant president of the University for Administrative Affairs, In addition to its direct association with the President of the University.

Among the tasks entrusted to the department is expressing opinion and advice on legal issues related to the application of laws and interpretation of ambiguous or vague legal texts, ratification of contracts for contractors with the university and guarantees related to students of primary and higher studies, sending warnings and receiving notifications, following up on lawsuits filed by or against the university, as well as following up the acquisition of The university from the current lands and to which it will be attached in the future.

 

Duties of the Legal Affairs Department

First: Duties and mission of the Director of the Legal Affairs Department

  • The main task: managing the department’s work, distributing tasks among the employees working in it, and carrying out the tasks of a notary public with regard to ratification of contracts and guarantees.

               Tasks and Duties:

 Supervising the performance of work in the department and following up the activities of its employees.

  • Distribution of tasks among the employees working in the department to run the work.
  • Completing the daily mail.
  • Providing legal advice to the university president.
  • Performing the tasks of a notary public with regard to ratification of contracts, pledges and guarantees for university employees based on the text of Article (9) of the Notary Public Law No. (33) of 1998 and the powers granted to him by the legal department in the ministry.
  • Participation in the work of the permanent or temporary committees assigned to it.
  • Proposing the formation of investigative and auditing committees for cases that require the formation of these committees, naming the legal member in them, and following up on the work of those committees.
  • Improve and develop the talents of the department’s employees by involving them in development and training courses inside or outside the university to ensure increasing their capabilities in performing their job duties.
  • General supervision of the work of all legal units in all scientific departments and in coordination with the officials of those units.
  • Accomplishing any other work assigned to him by his director.

Second: Duties and missions of the assistant director of the Legal Affairs Department

1-The main task: assisting the manager in managing the department according to work distribution orders.

2-Duties and Duties:

 1- Follow up the implementation of the instructions and margins of the department manager.

 2- Follow up the mail between the people and the department manager.

3- Checking the books completed by the department’s divisions, placing a margin on them, and referring them to the department manager for signature.

 4- Check the attendance of the affiliates.

5- Preparing the department’s employees’ performance evaluation forms, following up on their completion, and referring them to the director for evaluation and approval.

6- Follow-up and supervision of the electronic archiving system in the department, in coordination with the concerned employee, checking and updating the employees’ data, and preparing a summary thereof to the department manager.

 7- doing any other work assigned by the Director.

 

Third: Tasks and duties of the Cases and Notifications Division

  • The main task:

Preserving the rights and funds of the university by filing lawsuits to claim its rights from others and defending the rights of the university by representing the university before the courts in lawsuits brought by third parties against the university.

                          

  • Tasks and Duties:

 Initiating and following up on cases in the name of the university against others and submitting all related appeals to the last stage of litigation.

  • Representing the university before the courts in all lawsuits filed by third parties against the university, following up on them, and submitting all related appeals to the last stage of litigation.
  • Following-up and supervising the work of the legal units in all scientific departments with regard to the lawsuits entrusted to those units and preparing a summary thereof to the department manager.
  • Conducting the notifications received to the Legal Affairs Department related to the lawsuits related to the university's employees.
  • Receiving notifications related to lawsuits filed by third parties against the university and taking appropriate measures in this regard.
  • Initiating criminal cases before the competent courts against anyone who is exposed to the university’s proceeds related to financial properties and all official papers through filing forgery cases and other lawsuits.
  • Doing any other work related to the division's work.

Fourth: Tasks and duties of the Legal Consultation Division

  • The main task: to provide legal advice to all academic and administrative formations of the university.

 

  • Tasks and Duties:
  • Answering the requests for legal advice in everything related to the work of the scientific and administrative departments and in coordination with the legal units in those departments.
  • Supervising and scrutinizing the legal advice provided by legal professionals in all scientific and administrative departments.
  • Answering inquiries and clarifications regarding the interpretation of legal texts and instructions.
  • Addressing the legal references in any problems related to the interpretation of laws, regulations and instructions.
  • Expressing an opinion on the procedures and activities carried out by the scientific and administrative departments and other formations and checking their integrity in the light of laws, regulations and instructions.
  • Accomplishing any other work related to the division's work.

Fifth: Tasks and duties of the Contracts and Guarantees Division

The main task:

 1- Ensuring the protection of the university’s financial rights with regard to those who are academically accredited, on scholarships, and those enrolled in study fellowships who breach their contractual obligations regarding study.

2- Securing the protection of the university’s rights through checking contracts for renting student dormitories’ buildings, rental contracts for kiosks, cafeterias, a restaurant, student club, parking lots and land, and contracts for cooperation mechanisms.

 3- Ensuring that the law and instructions are applied correctly in everything related to the sale and lease of state funds.

2- Tasks and Duties:

  • Organizing the transactions of sponsorships for study leave outside and inside Iraq, scholarships contracts, and auditing legal agencies for students and professors on scholarship.
  • Organizing all legal undertakings for university affiliates, following up and supervising all undertakings that are organized in all scientific and administrative departments and in coordination with the legal units in those departments.
  • Studying and auditing the lease contracts for the buildings of the internal departments in coordination with the legal unit in the Department of Internal Departments, and following up and auditing the lease contracts for kiosks and cafeterias located in all the university and in coordination with the Government Contracts Division.
  • Ensuring the safety of applying the law of selling and renting state funds in everything related to the sale and renting of university funds and auditing its contracts.
  • Preparing formulas for cooperation mechanisms concluded between the university and governmental and non-governmental agencies, and studying and auditing the formulas of memoranda of understanding or cooperation concluded by the university with those parties.
  • Accomplishing any other work related to the division's work.
